Competition Terms and Conditions
1.1 We are Fluidic Analytics Limited and our registered office is at Unit A, The Paddocks Business Centre, Cherry Hinton Road, Cambridge, United Kingdom, CB1 8DH.

1.3 All entries are subject to these terms and conditions.
1.4 In conjunction with the terms and conditions below, we also recommend that you read and understand the following:
1.5 We always try to avoid unnecessary disappointment but in some cases it may not be feasible to continue running the competition if for example, we do not receive sufficient entries. If we need to cancel this competition for any reason, we will notify all Entrants of this by email.
What is the Competition?
1.6 We are holding a competition for one individual (the “Winner”) to win 1 Fluidity One-W or Fluidity One-W Serum instrument for a three month placement along with 576 consumable chips and 6 cartridges (the “Prize”).
Who can Enter?
2.1 This competition is open to research scientists in the field of life sciences (“Entrants”)
2.2 Entrants must be over the age of 18 years old to enter.
2.3 Entries will only be accepted from Entrants based in the following countries: Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom and United States of America
How do I enter?
3.1 To enter the competition, the Entrant must complete our entry form which can be accessed here
3.2 Your entry form must describe:
- the experiments you wish to perform on the placement
3.3 You should read and follow the instructions on the entry form carefully. All entries must be made in English and must not exceed the word count specified in the entry form.
3.4 Entry forms must be submitted online at the official place; www.fluidic.com/ResearchChallenge2020
How will my Entry be judged?
4.1 The judging panel will take the following criteria into account when reviewing each entry:
- how useful and interesting the proposed experiment is; and
- whether we believe the idea is possible, how relevant the experiment is to Fluidic Analytics and the capabilities of the Fluidity One-W.
4.2 After reviewing all entries, the judging panel will select three shortlisted Entrants as finalists (the “Finalists”).
4.3 The judging panel will contact the Finalists to discuss their entries and may request certain amendments to their entry. If a Finalist does not agree to these amendments unfortunately your entry must be withdrawn from the competition.
4.4 The Finalists must agree to any amendments together with the judging panel. Once the amendments have been agreed, the Finalists’ initial entry may be edited and developed by Fluidic Analytics in conjunction with the Finalist, into a final agreed entry that both Fluidic Analytics and the Finalist must sign.
4.6 The winner will be consulted with before any publicity, to ascertain which (if any) parts of the data should be anonymised.
Who will be Judging my Entry?
5.1 All entries will be evaluated by the judging panel consisting of:
- Chief Commercial Officer;
- Head of Technical Support;
- Head of Tactical Marketing;
- Director of Clinical Markets
5.2 The decision of the judging panel is final and cannot be contested.
What are the Key Dates?
6.3 You can make your entry online from 30th September 2020 to 18th December 2020. Any entries received outside of these dates will not be considered by the judging panel.
6.4 The judging panel will review all entries by 8th January 2021
6.5 Finalists will be notified by email/phone no later than 13th January 2021
6.6 The Winner will be selected on 22th January 2021 and notified by email/phone no later than 31st January 2021.
No Consequential Damages; Limitation of Liability
7.1 Fluidic Analytics shall not be liable to the Customer whether in contract, tort (including negligence), breach of statutory duty or otherwise for consequential losses, damages, for anticipated or lost profits (direct or indirect), incidental, special, indirect or punitive damages, any failure to realise anticipated savings or benefits, loss of time, loss or corruptions of data, delays on projects or product launches, loss of goodwill, loss of opportunity, loss of operation time, loss of use or wasted management or staff time, even if advised of the possibility of such damages in connection with the Contract. Fluidic’s aggregate liability relating to the Contract, including the Products or Services provided hereunder whether in in contract, tort (including negligence), breach of statutory duty or otherwise shall not exceed the amounts paid to Fluidic Analytics by the Customer for the relevant Order to which the claim relates.
7.2 Nothing in these terms and conditions shall limit or exclude Fluidic Analytics’ liability for: (i) death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable), (ii) fraud or fraudulent misrepresentation (iii) breach of the terms implied by section 12 of the Sale of Goods Act 1979, or (iv) any other matter in respect of which it would be unlawful for Fluidic to exclude or restrict liability.
7.3 Fluidic Analytics will not be liable for any costs of procurement of substitute deliverables or other products or services, nor for any loss of business, loss of use or of data, interruption of business, lost profits or goodwill, or other indirect, special, incidental, exemplary or consequential damages of any kind arising in connection with this Agreement, even if it has been advised of the possibility of such loss, and notwithstanding any failure of essential purpose of any limited remedy. This exclusion includes any liability that may arise out of third-party claims. Under no circumstances will the total and aggregate liability of all kinds arising out of or related to this Contract (including all Orders), regardless of the forum and regardless of whether any action or claim is based on contract, indemnification obligations, tort or otherwise, exceed for Fluidic Analytics at any point in time the total amount paid to Fluidic Analytics under this Agreement for the Products or Services giving rise to such liability over the twelve (12) months prior to that point in time. The foregoing limitation in this Section 6.3 is cumulative, with all payments for claims or damages being aggregated to determine satisfaction of the limit, and the existence of one or more claims will not enlarge that limit. Each party acknowledges that these limitations will apply notwithstanding any failure of essential purpose of any limited remedy. No claim, suit or action will be brought against Fluidic more than one year after the related cause of action first occurred.
